Plume and Plume Money are subsidiaries of Coco & Rex LLC ("Plume Money," "we," or "us"). By accessing or using the Plume Money platform (the "Service"), you agree to be bound by these Terms. If you do not agree, you must not use the Service. You represent that you are at least 18 years old (or the age of majority in your jurisdiction if higher) and capable of entering into a legally binding contract. Our Service is offered only to users located in the United States or Canada; by using Plume Money, you confirm that you reside in the US or Canada and meet all eligibility requirements. If you are using Plume Money on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms.
Account Registration and Verification
To use Plume Money, you must create an account with truthful and complete information. You agree to provide and maintain accurate personal and business details (such as your name, address, email, phone number, etc.) and to keep them updated. Identity Verification: Because Plume Money is a financial facilitation service, we are required by law to verify your identity before allowing certain transactions. You authorize Plume Money to collect information and documentation to verify your identity (e.g. name, date of birth, government ID, Social Security or Social Insurance number, business EIN) and to share this information with our verification service providers for compliance purposes. We may also require you to provide additional information or pass Know-Your-Customer (KYC) and Know-Your-Business (KYB) checks at any time. By opening an account, you consent to such checks and agree that we may deny, suspend, or terminate your account if you do not comply with our verification requests or if we suspect fraud or unlawful activity.
You are responsible for safeguarding your account credentials. Do not share your password, and notify us immediately at team@plume.money if you suspect any unauthorized access or security breach. You are liable for all activities conducted through your account. Description of Services
Plume Money Platform: Plume Money is a fintech platform that enables businesses and individuals (e.g. homeowners and contractors, or clients and service providers) to manage projects with milestone-based payments in a secure manner. Our Service allows a paying party ("Customer") to deposit funds for a project milestone and release those funds to the service provider ("Provider") upon completion of that milestone, with tools for evidence submission, approval, and dispute resolution. Plume Money is not an escrow agent, bank, or trust company, and we do not offer banking services or fiduciary services. While we often use the term "escrow" informally to describe the holding of funds, we operate as a technology platform that facilitates payments through third-party financial institutions. There is no intention to create a legal trustee or escrow agent relationship; no fiduciary duty or special relationship is established between you and Plume Money by these Terms.
No Endorsement or Guarantee of Users: Plume Money is a neutral venue. We do not endorse, guarantee, or warranty the work or behavior of any user (Customer or Provider) on the platform. Users are independent parties; any contract for services or goods is solely between the Customer and Provider. Plume Money is not a party to your project contracts and is not responsible for the quality, timing, legality, or outcomes of any work or services provided by a user. We do not control and are not liable for what Users promise or deliver. You acknowledge that Plume Money is not responsible for the conduct, whether online or offline, of any user, and you release us from any liability arising from or related to any user's actions or omissions. Each user is solely responsible for fulfilling their obligations to other users, and for complying with all applicable laws in doing so.
Payment Terms and Financial Services
Payment Processing: All payments on the Plume Money platform (including funding of milestones, holding of funds, and disbursement of payouts) are handled by our third-party payment processors, Stripe and Banking partners. Plume Money itself does not physically hold your funds – any funds designated for a project are held in a custodial account managed by Stripe and Banking partners or similar licensed payment institutions. By using Plume Money's payment services, you agree to be bound by Stripe and Banking partners' Terms and Conditions and any other relevant payment processor terms, as they may be updated from time to time. This means, for example, that you agree to Stripe and Banking partners' acceptable use policies and will not engage in prohibited transactions. We will facilitate the creation of your payment account as needed, and you authorize us to share your necessary information with Stripe and Banking partners to set up and maintain payment services. All transactions (deposits, payouts) are ultimately processed by Stripe and Banking partners, and Plume Money assumes no liability for any issues arising from Stripe and Banking partners' services (such as payment delays, holds, or errors), though we will assist in communicating with Stripe and Banking partners to resolve problems.
No Banking Relationship: As noted, Plume Money is not a bank and does not offer traditional banking services. The funds you deposit are not deposits in a bank account and are not insured by the FDIC (USA) or CDIC (Canada) or any government deposit insurer. Instead, your funds are held as electronic money by our payment partner. We do not pay interest on funds held (any interest that may accrue on pooled accounts is retained by the financial institution or us, as applicable, to cover service costs). You acknowledge and agree that Plume Money is not acting as a fiduciary, trustee, or escrow agent on your behalf with respect to funds. Plume Money facilitates the movement of funds according to these Terms and your instructions, but does not guarantee any outcome once the funds are released to the intended party.
Service Fees: Plume Money may charge fees for the use of our platform and services. Any applicable fees (for example, a platform fee or transaction fee) will be disclosed to you before you confirm a transaction or subscription. By using the Service, you agree to pay any such fees, and you authorize Plume Money (or Stripe and Banking partners on our behalf) to deduct our fees from amounts held or processed. All fees are non-refundable except as required by law or expressly stated otherwise. We reserve the right to change our fees in the future with reasonable notice to you (e.g. by posting an update or emailing you). Prices and fees are listed in U.S. dollars unless stated otherwise, and any currency conversion (if we ever support multiple currencies) may involve additional costs. You are responsible for any taxes (e.g. sales, VAT, etc.) that apply to your use of Plume Money; we do not withhold taxes on your behalf except as required by law.
90-Day Money-Back Guarantee
Plume Money offers a 90-day money-back guarantee on paid subscription plans. If you are not satisfied with your Plume Money subscription within the first ninety (90) days of your initial subscription purchase, you may request a full refund of your subscription fees by contacting us at team@plume.money.
Scope of Guarantee: This guarantee applies exclusively to subscription plan fees (Solo, Pro, Team, and Enterprise monthly or annual subscription charges). The guarantee does not apply to transaction fees or platform fees charged on milestone payments processed through the Service, any fees associated with payment processing, fund transfers, or disbursements, third-party fees or charges incurred through Stripe, banking partners, or other service providers, or fees for add-on services or features purchased separately from the subscription plan.
To request a refund under this guarantee, you must submit your request within 90 days of your initial subscription purchase date. Refund requests made after this 90-day period are not eligible. Upon approval, refunds will be processed to the original payment method within 5-10 business days. This guarantee is limited to one refund per customer and may not be combined with other promotional offers or credits.
Project Milestones & Fund Disbursement
Plume Money's workflow centers on project milestones and associated payments. The following terms govern how project funds are managed and released:
- Funding a Milestone: When a Customer agrees to a milestone with a Provider (e.g. a specific task or phase of the project for a set price), the Customer is required to deposit the agreed amount for that milestone into the Plume Money system (via our payment processor). Once payment is made, the milestone is considered "funded" and we will hold the funds (via Stripe and Banking partners) pending completion. Funds for a milestone are earmarked for that specific milestone and cannot be withdrawn by the Provider until release conditions are met as described below. The Customer retains the right to approve or dispute release of these funds during the review period.
- Completion and Submission: Once the Provider believes the milestone work is completed, they will submit the milestone for approval through the platform, along with any required evidence or documentation (e.g. photos of work done, reports, files, etc.). This submission triggers a notification to the Customer that the milestone is ready for review. The timestamp of the Provider's submission is recorded by our system, and this will be used to calculate all response deadlines.
- Customer Review Period (45 Days): The Customer has forty-five (45) days from the time the milestone is submitted by the Provider to review the work and take action. During this 45-day review period, the Customer may approve the milestone, request changes, file a dispute, or take no action. If the Customer does not take any action within 45 days of the Provider's submission, the milestone will be automatically marked as approved and the funds will be released to the Provider.
- Automatic Approval on Inaction: If the Customer does not take any action within 45 days of the Provider's submission, the milestone will be automatically marked as approved and the funds will be released to the Provider. In other words, silence or inaction for 45 days is considered acceptance of the work and consent to pay. Plume Money implements this rule to encourage timely feedback and to protect Providers from indefinite delays.
Dispute Resolution Between Users
While we hope that Customers and Providers can resolve most issues themselves, we provide a structured dispute resolution process for those situations where you cannot reach an agreement regarding milestone completion or payment. By using Plume Money, you agree to abide by and participate in our dispute process in good faith, and to accept our decision as final and binding for purposes of releasing or reallocating funds held in escrow. The dispute mechanism is intended to decide the allocation of funds in the specific milestone; it is not a court or arbitration for broader legal claims.
The dispute process includes: (1) Initiating a Dispute through the platform within the 45-day review window, (2) Response and Evidence from Both Sides, (3) Plume Money Review using our internal team and AI-assisted analysis, (4) Decision Outcome (full release, full refund, or partial split), and (5) Post-Dispute Options for external legal remedies if needed.
User Conduct and Prohibited Uses
You agree to use Plume Money only for lawful purposes and in a manner consistent with these Terms and all applicable laws and regulations. You MUST NOT:
- Violate Laws or Regulations
- Engage in Fraud or Deception
- Attempt Unauthorized Access and Security Violations
- Interfere with the Service
- Circumvent the Platform
- Use for Prohibited Transactions
- Abuse or Harass others
- Infringe Intellectual Property
Limitation of Liability
To the fullest extent permitted by law, in no event will Plume Money or its officers, directors, employees, or agents be liable to you for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of (or inability to use) the Service. To the extent we are found liable for any claim arising from or related to these Terms or the Service, our total cumulative liability to you is limited to the greater of: (a) the total fees (if any) you paid to Plume Money in the 3 months immediately preceding the event giving rise to the claim, or (b) USD $100.00.
Governing Law
These Terms and any dispute arising out of or relating to these Terms or the use of the Service are governed by the laws of the State of Nevada, USA, and (to the extent not preempted) the federal laws of the United States, without regard to its conflict of laws principles.
Dispute Resolution & Arbitration
You and Plume Money agree that any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Service will be resolved solely by binding individual arbitration on a case-by-case basis, except as provided in the Terms. This includes claims based in contract, tort, statute, fraud, misrepresentation, or any other legal theory. By agreeing to these Terms, you and we are each waiving the right to a trial by jury or to participate in a class action lawsuit or class-wide arbitration.
If you do not wish to resolve disputes by arbitration on an individual basis, you may opt out of this arbitration agreement within 30 days of the date you first accept these Terms by emailing us at team@plume.money with a clear statement that you opt out of arbitration.
